Lets suppose Kormoran indeed opened fire under false flag, or white flag?
How exactly it reduces the responsibility of Cpt Burnett, or makes the Sydney
any less "negligently handled"?

You are simply not making any sense.

It is obvious that Sydney received critical damage from very close distance.
It is unlikely Kormoran could have hurted Sydney from any longer distance.
Sydney should not have got so close - period.

By the way, did you know that German raiders had a mechanism which allowed them
to replace the colours flying in few seconds?
